Who needs to be authorised under MiCA?

Firms providing crypto-asset services to clients in the European Economic Area must be authorised as a Crypto-Asset Service Provider (CASP), unless a specific exemption applies.

Which crypto-assets does MiCA cover?

MiCA covers crypto-assets that are not already regulated as financial instruments, including asset-referenced tokens, e-money tokens and other crypto-assets such as utility tokens.

How does MiCA protect crypto-asset holders?

A CASP must segregate client crypto-assets and funds from its own, safeguard them so they can be returned to clients, provide clear disclosures and operate a complaints procedure, all under ongoing regulatory supervision.

Can a MiCA authorisation be used across the EU?

Yes. Once authorised in one member state, a CASP can passport its services across the EEA after notifying the relevant authorities, so a single authorisation covers the whole area.

Does MiCA remove the risk of crypto-assets?

No. MiCA sets conduct, disclosure and safeguarding standards, but it does not remove market risk. Crypto-assets remain volatile and their value can fall as well as rise.
